still no refund from ebay buyer protection

Bought macbook on August 2nd. Took ages to come and when it arrived it was nothing like description.

Given how long it took to arrive (nearly 2 weeks) and the bad comms from the seller I rased a not as described dispute. He then gave me an address and I sent it back.

Item returned recorded delivery and signed for on July 19th, case found in my favour July 23rd but despite 8 phone calls to ebay and numerous unanswered emails still no refund. Still shows as suspended in sellers paypal account. Just keep getting told it's being dealt with by management. Who are the mysterious management and how do you contact them?

I am calling ebay USA via skype tonight to complain and see if they help. Probably the same call centre!

Whilst I agree that it is a good thing that ebay/paypal suspend the disputed funds in the sellers account to stop them withdrawing them they shouldn't remove the 'refund' button as in my case seller and buyer are happy that a full refund would close the case he just hasn't got another £440 to refund me so that I can close the case and my original payment would be released in his account!

Or it could be that the seller doesn't want to cough out his own money to refund your payment. Its difficult since his account has been frozen by PayPal. But most sellers will refund their customers either way, especially if the item has been returned to them. I think you should make a follow-up with your seller about your refund. Who knows when PayPal will lift the hold on your seller's account - it may be in the next couple of weeks or it may take as long as 90 days before his funds are released. Are you willing to wait that long? The chance of loosing your money is quite high at this point. I mean the seller may be dodgy that is why his account has been suspended..I could be wrong but my gut just doesn't feel too well reading your post :roll:

I do hope you get your money back, GBP440 is GBP440.

In the US, ebay will refund the buyer from their own insurance program while retrieving the funds from the seller.
Paypal has the same policy in the US.

Did the seller ship from or to the US?

If either, then you should contact the ebay US dispute 1+ 866-643-1588
When prompted for PIN follow prompts for "DO NOT HAVE ONE"

I have been using eBay USA for several years now, and recently encountered my first buying problem ever. I'd have to say, I always believed that eBay was very safe, since everything I'd ever ordered arrived as expected; sometimes better than I'd hoped. Well, I ordered a Nintendo DS for a birthday gift, and after using Buy It Now, realized the buyer had 0 feedback. I was concerned, but thought, "well, everybody has a first time, give them a chance, if it doesn't work out, there's eBay buyer protection." :lol: You can guess where this is going. I ended up receiving a paper envelope (not a bubble mailer) with a piece of scotch tape on it, completely open, and filled with plastic bags and an empty Nintendo DS box, and now I am the one left with the burden of truth. I immediately went to the post office and complained. My post office was surprised the item was allowed to be shipped that way, with no packing tape or anything on it. I was wondering if this was intentional on the sellers part. EBay customer support was so unhelpful. I was not happy with the sellers responses. I would email through eBay, they would wait 5 days to respond, and the response was always very vague, mainly stating that this was my problem, and their post office was fine with the way it was shipped. They wanted me to file a claim, which I said was fine as long as I was issued the receipts from the post office with the insurance information, and that was never given to me either. I kept contacting eBay, who kept giving me the runaround and telling me "not to worry." Never in a million years did I ever think I would spend $100 and end up with nothing, and no help from eBay. I escalated the claim, eBay ruled in my favor, sent me a return label, and promised a refund three days after proof of delivery. Proof of delivery arrived, and after waiting over a week for a response, a refund did not. I called eBay three times, and eBay customer service now tells me I need to contact the seller again and ask them for a refund and wait another 72 hours, after originally being told my contact with the seller was over, and now eBay is handling the problem. I hung up, called back, got somebody else, (much more helpful than last rep) and FINALLY ended up being transferred to an ebay buyer protection agent. This is where my refund was issued within a matter of minutes. I am writing this out of frustration, and also to give some advice to anybody encountering a problem like this. I notice a lot of complaints about eBay siding with Buyers and ripping off the Sellers, but I can say from firsthand experience, that road can definitely go both ways. There are also horrible sellers out there, and eBay Buyer Protection needs to start doing their job.
