I have been using eBay USA for several years now, and recently encountered my first buying problem ever. I'd have to say, I always believed that eBay was very safe, since everything I'd ever ordered arrived as expected; sometimes better than I'd hoped. Well, I ordered a Nintendo DS for a birthday gift, and after using Buy It Now, realized the buyer had 0 feedback. I was concerned, but thought, "well, everybody has a first time, give them a chance, if it doesn't work out, there's eBay buyer protection."

You can guess where this is going. I ended up receiving a paper envelope (not a bubble mailer) with a piece of scotch tape on it, completely open, and filled with plastic bags and an empty Nintendo DS box, and now I am the one left with the burden of truth. I immediately went to the post office and complained. My post office was surprised the item was allowed to be shipped that way, with no packing tape or anything on it. I was wondering if this was intentional on the sellers part. EBay customer support was so unhelpful. I was not happy with the sellers responses. I would email through eBay, they would wait 5 days to respond, and the response was always very vague, mainly stating that this was my problem, and their post office was fine with the way it was shipped. They wanted me to file a claim, which I said was fine as long as I was issued the receipts from the post office with the insurance information, and that was never given to me either. I kept contacting eBay, who kept giving me the runaround and telling me "not to worry." Never in a million years did I ever think I would spend $100 and end up with nothing, and no help from eBay. I escalated the claim, eBay ruled in my favor, sent me a return label, and promised a refund three days after proof of delivery. Proof of delivery arrived, and after waiting over a week for a response, a refund did not. I called eBay three times, and eBay customer service now tells me I need to contact the seller again and ask them for a refund and wait another 72 hours, after originally being told my contact with the seller was over, and now eBay is handling the problem. I hung up, called back, got somebody else, (much more helpful than last rep) and FINALLY ended up being transferred to an ebay buyer protection agent. This is where my refund was issued within a matter of minutes. I am writing this out of frustration, and also to give some advice to anybody encountering a problem like this. I notice a lot of complaints about eBay siding with Buyers and ripping off the Sellers, but I can say from firsthand experience, that road can definitely go both ways. There are also horrible sellers out there, and eBay Buyer Protection needs to start doing their job.
