hi there....

this is sandesh from india...I recently purschased a mobile phone from UK seller....with 100% feedback...and it was supposted to be shipped within 15 to 20 days...but not yet arrived after having around one and half months..i have paid through paypal..and i have also open a dispute thru paypal....now the buyer is saying that she has contacted the royalmail and also filed a claim for lost item...on royalmail by which it was dispatched to india.....the deadline for the disupute is 21 june..2007....now i want to known can i get my money back...if i esclaim this case to paypal...becuse our converstion regaridng the delivery is not going anwhere i mean it is becoming endless...so if i esclaim this to paypal...then can i get my money back...

If you escalate to a claim, then it is up to the seller to provide proof of delivery, which they will not be able to do as it never arrived, and no standard Royal Mail services offer tracking beyond the UK. Besides, Paypal seller protection is only applicable if the buyer is verified, and curently only buyers in EU, UK, USA & Canada can be verified.

The seller wil only be able to claim a maximum of £34 compensation, unless they sent it with extra insurance. Check the UK Royal Mail Websitefor more details.

The seller may be reluctant to refund you directly if they only get the £34 back, so get it escalated asap.

As far as the laws of the UK go, the seller is responsible for the item until the moment it is delivered to the buyer - ignore any listings that state different, it can not be enforced, and besides, Paypal will ALWAYS side with the buyer if delivery can not be proven!
