I'm new to this forum. But I have a question. I work for an organization that manufaturers and markets clinicial foods. These products are sold on ebay. How do I go about getting them excluded from ebay?

You need to register with eBay as a Verified Rights Owner, or VeRO.

In order to participate in the VeRO Programme, all you need to do is fill out and fax to us a Notice of Infringement form specifying the allegedly infringing listings and infringed works, complete with an original authorised signature.

The information requested by the Notice of Infringement is designed to ensure that parties reporting items are either rights owners or authorised by the rights owners, and to enable eBay to correctly identify the material or listing to be ended. After your first Notice of Infringement is received by us, you'll be able to transmit future notices to eBay by email.

I'm not 100% certain on this bit, but I believe that you will have to manuall search for forbidden products, and report them to eBay yourself - eBay has very little in the way of automated policing of the site. Why would you want to get them excluded from Ebay? Are they selling below a minimum standard sell price or do your terms and conditions state that the prodcuts can't be sold at online auctions....

If the manufacturer has set up exclusive distribution rights with wholesalers, there is a duty of care to protect that deal to ensure the wholesaler is not undercut, and to prevent the product dilution.

There may well be a list of licensing and reselling caveats attached to the product that can only be met by authorised stockists, so sellers on eBay will not legally permitted to advertise the product.

And of course there is brand image - it's not unknown for exclusive brand owners to pull the listings under Vero as eBay sales cheapen the image.
