As you already know I open up an auction site http://www.ggavel.com because of how I was treated with ebay!

ok.. well I had an ebay account for 6 years, sold lots of misc things! I have a feed backrating off 100.% positive. My ebay name is Carkustom if you want to check it out. http://myworld.ebay.com/carkustom

I sold a brand new cell phone to a guy that lived in NY for $875. It was an Iphone 3gs 32gb unlocked. The guy filed a claim on me and said the phone didnt work. Ebay wins the claim in the guys favor and the buyer sends the phones back to me. When I received the phone, it was a package from Saudi Arabia! and it was switched with a phone that would not power on! I appealed the case and call ebay over 6 times about the issue, I even stated that the s/n # on the box and my reciept dont match the phone and the phone was broken and returned from an overseas address. Well, they still won it in the buyers favor and debited my paypal for $875.00 and sent me some kind of "sorry this was not the answer / outcome you were looking for" email!

My account balance is -$875 and im NOT going to pay it. I was scammed out of a phone for a broken one! So that why I got screwed by ebay.

It's sad how things can oftentimes be quite unfair on eBay. Hopefully you'll do better with your new site!

All the best :D

Well there must have been some misunderstanding or any technical issue because a reputed site like e bay can not do this .. Check it out with them!

Hi ggavel, best of luck with your site. Pity you don't sell eBooks from it, you'd have lots of sign ups if you did.

Onto the eBay saga: As your post was over 2 years ago you've probably solved the problem or moved on from it, but for future reference I wrote a blog post on how eBay are trying to help sellers with difficult and troublesome buyers.

There's a link within the post to an eBay help page where you can report buyers for pulling strokes like this. Bookmark it for if and when you ever need it.

Thanks for sharing your blog post on how eBay are trying to help sellers with difficult and troublesome buyers :)

Oftentimes situations like these are case to case basis - some get resolved while others are left hanging. Most vital would be the fact that you should try to mediate the issue between you and the seller/buyer prior to contacting eBay resolution center. If things don't resolved then eBay is your next best solution.

Its just very unfortunate that many are left unresolved and left hanging in the air...it leaves too much negativity :(

You really need to file a lawsuit in your local small claims court for the amount you are out including court costs.

Ebay will have to send a lawyer to fight the charges, and you will most likely win because lawyers are not expected or appreciated in small claims court.

ALSO file a complaint with the Better Business Bureau, The Federal Trade Commission, The United States Postal Service, and your local State's Attorney General.

ALL OF US HAVE TO FOLLOW THESE SAME STEPS TO FORCE EBAY TO STOP BEING BIASED AND PROVIDING COMPLICITY TO THIEVES AND FRAUDULENT BUYERS!!!

Your suggestion may just work out, Geoffrey.

@ggavel: How's your new site? It has been 3 months now, hope you're doing fine and getting back more than the money you lost on eBay.

Cheers :)

Hi Geoffrey,

Yes, there seems to be a decline in sales for a number sellers and sites as well. But hopefully it will soon pick-up as we start the '-ber' months. Today officials starts it. In the past people somehow go into a shopping frenzy around this time of year. Probably due to the hard economy, people (especially buyers) have become a bit more picky and thrifty when it comes to online shopping.

Cheers :)
