EBAY BUYER DID NOT PAY! PLEASE HELP!

Hi,

This is the message from a buyer on eBay after accepting an offer on the item I was selling.

I tought you would not accept my offer so I bought another pair.... I would like to canel this transaction, so please just go to RESOLUTION CENTER and choose WE BOTH AGREED TO CANCEL THIS TRANSACTION.... that way I will be fine and you will have your ebay fees returned

As I see them, my options are the following:
1. do as he says - I'm not sure I would get back my eBay fees since I agreed to cancel - so I won't do that
2. follow steps of in resolution centre of unpaid item - not sure what happens in this case - best case scenario I get my eBays fees returned? - can I leave feedback afterwards in this case?
3. Tell the eBayer that didn't pay I will cancel his transaction AFTER he gives me positive feedback. This way I cancel the transaction and leave him negative feedback. I don't want to leave him negative feedback no as he'll give me negative feedback for NO reason.

Some information on the item I was selling:
Pair of designer jeans. Buy it Now was $499 and he offered me $300. I charged $35 shipping from Canada to USA which I think is reasonable giving the value of item and next day shipping etc. I had everything listed for my item - detailed measurements of the size, several pictures etc. I waited a day to see if I would receive any more offers, I declined some at $250. I accepted best offer of $300 and next day I receive this message.

Please, has anyone had this situation before? What is the best method? I think 2 is probably best but 3 maybe even better?

I haven't exactly encountered such an issue so I did a little reading and learned a few things. You can actually choose to resolve the whole issue between you and the buyer but if you are not confident you can make you of eBay's Unpaid Item Assistant in the Resolution Center. I just want to point out that if your problem isn't resolved, the following scenarios may take place:

*If the buyer didn't pay, you may be credited for the final value fee.
*You can extend a Second Chance Offer to another bidder.
*You can re-list the item (and you may be credited for the insertion fee as well as the final value fee).
*If you want a refund for your credit, see requesting a refund from eBay.
*When you close the case, our Trust and Safety team is automatically alerted. Actions may include recording unpaid items on the buyer's account, which can lead to limits or suspension of that buyer's account.
*The buyer can appeal the unpaid item.

if you both accept mutual agreement of cancelling trade , you will get back final value from ebay .but listing fee is not refunded

You cannot leave a buyer negative feedback at all, so your best option is to go through the mutual cancel transaction process. You will at least get your final value fee credit. If you go through the non-paying buyer process, you will get your final value fee refunded, but then also get a negative feedback.
YOU CANNOT tell the buyer they MUST LEAVE YOU POSITIVE FEEDBACK BEFORE YOU WILL AGREE TO CANCEL THE SALE. This is FEEDBACK EXTORTION and will get you in serious trouble with ebay.

DO tell the buyer to please leave you a fair and honest feedback then you will agree to the mutual cancel of the sale. Explain to the buyer that you are out the listing fees and this is why you are requesting that they leave feedback first.

Then after you receive a neutral or positive feedback agree to the mutual cancel.
IF the buyer leaves you a negative, go through the non-paying buyer process.

Then regardless, leave a "Follow Up" feedback and put in it. "Buyer canceled purchase after making accepted offer."
