Buying directly from seller without auction, HELP!!! Paypal

Hi everyone,
I was shopping around for a cell phone and found one that I liked, I emailed the seller a question, and he answered, then he wanted to cut a deal and said he would end the auction if i gave him 75 for the phone. We emaield back and forth 13 times in less than an hour, I paid him, and 17 days later no phone. I emailed him many times with no answer...i threaten with payapl disputes and now I escalted my dispute...but my question is will i get my money back if it wasn't auction format?? Please help. It's been 3 days since I escalated the dispute and he still didn't anwer.

Welcome to the forum.

As you'll probably know Off eBay deals are generally frowned upon from eBay & paypal. How was the $75 payment funded, was it out of your paypal balance or though a credit card?

Well, if paypal doesn't find in your favour contact your credit card who can dispute the item & transaction for you. Have you had any contact from the seller yet?

eBay is really out of the loop at this point. Your best bet is through PayPal, which has better customer service than eBay. And don't forget it's all tied back to your bank and/or credit card company which typically provide you with some potection against faud if you are willing to go through the process to file a claim.

thanks everyone for your advice and I will surely keep everyone posted and updated.
THE LATEST:
I escalated the dispute to a claim with paypal and the selelr didn't reply for 3 days...until yesterday...he provided tracking information with UPS, which of course was a tracking number for a package that was shipped to Florida in March...and I live in Illinois and it's July now...right now, it's a waiting game :cry:
