Buyer breaks the rules - Saller pays for it

To simplify my listings I use a lot of the built in options. I live in the UK and as I did not want to get involved in problems that can occur shipping to countries outside of the UK I set my default shipping to ebayers registered in the UK only.

I recently sold an item only to find out that the winning bidder although registered as living in the UK he was currently living in Holland.

I informed him that as he lived in a country to which I do not deliver he did not fulfill my listing requirements I was therefore cancelling the sale of the item to him. Although he was prepared to give an address of a third party in the UK as this address is not a paypal verified address (the holland address is also not verified) I would not be covered by the paypal seller protection policy; something I am not prepared to risk; the item sold for £75; I could have lost the lot if there was a problem with delivery; callback by the winning bidder etc..

I also reported the user to ebay as he was in breach of the ebay policy "False or missing contact information"; he was registered as living in UK when he was actually living in Holland.

Eventually I did get a reply from ebay; I could open a cancel transaction case. This is where the problems start.

If the winning bidder agrees to the cancellation or does not answer within 7 days then I would get the final value fee refunded. (£7.50). If he did not agree to the cancellation I would not get the final value fee refunded. The winning bidder did not agree to the cancellation.

The winning bidder can also leave a negative feed back; fortunately you can now ask ebay to review unfair feed back comments.

The standard replies from ebay are no help; just try and sort it out with the winning bidder.

I have responded requesting what can I do to have ebay review this case. It is my opinion that the winning bidder has broken the rules and that I am paying for it. If the winning bidder had registered his account properly as living in Holland he would not have been able to bid on my item and I would not have been in this situation.
