bought from an apparent solid Ebayer...No Guitar

On The 10th of December I bought a guitar from what looked to be a solid Ebayer with 45 feedbacks @ 100%...I paid $2270 canadian via Paypal straight away...
He took a week or so to prepare it for sale according to his emails, then he eventually said he had sent it on the 22nd of December and that he'd supply a tracking No...
I sent about 3 emails asking for the tracking No that he promised...over a Ten day period...I got "soft" answers that amounted to nothing...
About 5 days ago he informed me that there was a mixup and that it hadn't been sent and that he would send it the next day...I said at this stage that it had become clear that he had been lying to me and that if he didn't send it by the end of business last Monday the 7th and advise me of the Tracking No, I would leave Negative feedback and set up a dispute with him via ebay...
He then told me that there had been a mix up and that there was now no guitar and that he would make it right...I told him that I would proceed with what I had said...He said that that he would therefore give me negative feedback...for what? paying straight away? Anyway tonight I did what I said I would do and I have also asked my lawyer to look at ways to prosecute him for internet fraud...Is there anyone who has had experience with prosecuting these scammers? I have 80 positives @ 100% that go back to 2000 when Ebay was brand new, nearly all my purchases have been for expensive guitars so it has been a slow process and I am bummed out about losing that perfect record when I have done all I could do by paying straight away and be patient for nearly 30 days... :?

Is there anyone who has had experience with prosecuting these scammers?


Personally, I don't know of anyone who's took legal action due to an ebay transaction. Please keep us informed of how your going to progress with this.

Has the buyer refunded the payment yet?, or have you disputed the transaction with paypal?

Most ebayers are savvy enough to take negatives in their stride, they realise that there are the idiots out there that are intent on ruining peoples 100% record.

My advice would be make sure you get your money back, add a feedback reply to state the scammer and move on and don't worry about it..
