Bad Seller!

I hope I'm on the right forum for this, but I really don't know what to do next.

I won an auction for a "like new" jacket, paid immediately, and received the jacket in a few days. I was very happy with how fast shipping was. Here's the problem; there are black permanent marker spots on the collar! It wasn't mentioned anywhere in the auction. In fact, the auction stated that there wasn't a mark on it! I wouldn't have bid if I had known about the marks.

After I noticed the marks, I emailed the seller immediately and asked about them. I told her that I felt like I had been ripped off. No response. The next day, I sent her another email asking if she had gotten the first one. No response. The third day I sent her an email pointing out that she has 100% positive feedback, and did she really want to risk that by not answering me at all? I told her that if I didn't hear from her, I felt I had no choice but to leave negative feedback about the item. No response.

I want to soon start selling on ebay, and I know that leaving someone negative feedback does harm to them. But then again, I was ripped off and ignored! What do you suggest?

Like I said, I want to start selling on ebay, and I don't want to jeopardize my own 100% positive feedback in case she retaliates or something stupid like that (she left me positive feedback when I paid for the item, but can't she retract and leave negative feedback?).

Any advice would be appreciated. I don't just want to screw her over, but I don't think she should get away with this!

No - feedback can't be removed with out your permission - in which case it would be a mutual feedback removal, removing the feedback both parties left.

There is a possibility that your emails may be grabbed by a spam filter, so she may not be receiving your emails.

I'd recommend:

1) Using ebay advanced search to get any contact details. try calling the seller to see if a solution can be reached.

If not, or no luck

2) Report the seller to ebay as a non performing seller (for misrepresenting an item which is delivered)
3) Leave the seller negative feedback

Thanks for your reply. I was able to reach her via ebay message the day she sent the item - she answered me right away. And I see that she's been leaving feedback for others during the last few days, so I know she's not out of town or anything.

Ugh... I hate the idea of leaving negative feedback. I'll follow your advice and first report her to ebay.

If you paid via Paypal then do a buyer complaint, otherwise you have tried all you can so follow the Ebay process and leave the negative. The feedback process is one of teh key elements to teh backbone of Ebay so should be actioned accordingly...

First do a paypal complaint, then if they give a refund, leave neutral. If they don't, leave a neg.

File a complaint with PayPal. And leave negative feedback.

File a complain with Paypal and request seller to get in touch immediately or you will file a chargeback followed by negative feedback on eBay. DOn't worry about her leaving negative feedback for you as she already left her feedback for you, this can't be removed unless it is a mutual feedback removal.

Give the seller certain time frame to response, if she still failed to response, the file a chargeback with Paypal.
