I sell new office equipment as the main part of my business and I use eBay to move the Ex Lease and trade in equipment with low meter readings. I service and fit new drums, toners and any other consumables that are needed before listing.
Recently a seller has started sellling the same equipment as me on eBay, but he is advertising it as "NEW" with the words Ex-Demo down further in the add. This puzzled me as the make and model of machines he is selling are 4 to 8 years old and couldnt possibly be new or Ex-Demo as described.
Recently he got negative feedback from a decieved buyer:

The true age of this equipment can be found at this Buyers Laboratory site where they test and rate office equipment when new, so the date of their reports can be used a reliable reference to establish the age of this equipment.

If you look down this list you will see that the model he sold this unhappy buyer (Toshiba eStudio 350) was tested in Oct 2004 making it 6 years old when it was listed as a "NEW" "Ex-Demo" on eBay.
I reported it to eBay and even went to the trouble of ringing the PowerSellers support line, but they didnt want to know about it. Apparently they are happy to allow this fraud to keep going on.
Whats worse is that this person offers a 6 month Warranty, but when you read down further his add says the warranty does not cover consumables. If he deems the problem to be related to a consumable then he charges for everything, the call out, labour and any parts he deems needs replacing.
As there is a long list of parts that manufacturers consider to be consumables like. Drums, heat rollers/film, drum cleaners, Ibt belt, Ibt cleaner, feed/seperation rollers, fuser cleaner, developer etc etc. In fact nearly anything in the machine that wears is a consumable, so 99% of what is likely to cause a problem in such an old machine is NOT covered.
Out of frustration I put this warning in my listings:

Beware another seller here is fraudulently advertising 4 to 8 year OLD office equipment as "NEW",or Ex Demo.
The equipment he sells is NOT new or even Ex Demo.
To check the real age of this equipment go to the buyers laboratory web site where they test equipment when new
and publish reports and reviews, the dates of these reports give an accurate age for the equipment.

If you think his behaviour is unfair complain to eBay.
I dont know if this is a smart thing to do as it may make me seem negative or petty, I dont know? Any advice or opinions from others out there would be appreciated.
